Lagos West Senatorial Election: Tribunal Set August 20th For Judgment

The election Petition Tribunal sitting in Ikeja Lagos, last week adopted the written address in the case brought before the tribunal by the Lagos -West Senatorial candidate Segun Adewale of the Peoples Democratic Party (PDP), challenging the declaration of All Progressives Congress (APC)’s candidate, Solomon Olamilekan Adeola as the winner of the April 28 election.

The three-man tribunal headed by Justice Sylvanus Oriji had last week adjourned the case to 20 August 2015, for judgment following the adoption of written address after listening to the arguments by both parties.

In the course of winding down the matter, the Counsel to the second respondent , Bar.Muiz Banire sought to tender two documents  but the Counsel to Mr. Adewale, Dr. Yemi Oke objected stating that by law, such documents should be presented at the trial and cannot be admitted.

Oke  based  his objection on the fact that the documents ought to have been tendered according to Section 42, by consent of  both parties at the pre -hearing session or by the respondent himself .

Hem therefore ruled the documents out of order but Dr. Banire sought to bring  in a motion for the documents to be admitted. However, he withdrew the documents after he was made to realise that the documents are foreclosed .

Dr. Oke maintained that based on all the documents and witnesses presented to the tribunal, he is confident that Adewale popularly known as Aeroland will be declared the winner of the election.

He said: “I have absolute confident in the law and the Tribunal. I believe that if the law and the facts  are followed and the overwhelming bundles of written evident that we presented before the court that the other party accepted and which the court admitted as evidence, then we can say definitely Mr. Adewale will be declared the winner of the election.

“The tribunal which has  had about 10 sittings did not see the respondent tender any evidence or bring up any witness but they are resting their case on ours”.

Mr. Adewale is contesting the election  on three grounds alleging that the nomination of Mr.Adeola is invalid, that election did not hold in some wards, among others irregularities which include falsification of results.
