Ibinabo Fiberisima: Jail bound actress heads to supreme court

The Court of Appeal in Lagos, today, Thursday, March 17, 2016, has reportedly fixed April 7 to hear the bail application submitted by Ibinabo.

Ibinabo Fiberisima following her five year jail sentencing for manslaughter has reportedly submitted a bail application with the Court of Appeal, Lagos.

The Court of Appeal in Lagos, today, Thursday, March 17, 2016, has reportedly fixed April 7 to hear the bail application submitted by Ibinabo.

The Nollywood actress had earlier been to five years in jail by Justice Deborah Oluwayemi of a Lagos High Court, for reckless driving and causing death.

Ibinabo is alleged to have recklessly driven a car resulting in an accident along the Lekki-Epe expressway, Lagos, causing the death of a Lagos State government hospital staff, Giwa Suraj.

The court, presided by Justice, UI Ndukwe-Anyanwu, had reportedly noted that in the processes before the court, Ibinabo had failed to attach copies of the court's judgment which affirm the jail term handed down by the lower court although the hearing had been adjourned to April 7 enabling the appellant to regularise the processes.

Ibinabo has however asked the Supreme Court to disregard the judgement of the lower court, stating that the Court of Appeal had erred in law following its affirmation of the Lagos High Court's interference with its exercise of discretion by the trial Magistrate's court.

She went on to add that the judgment of the Court of Appeal had been unreasonable and should not be supported considering the evidence brought before the court.

 

NAN reports that a six paragraph affidavit of urgency deposed by one Victor Eden, revealed the deponent asserting that Ibinabo was currently recovering from a surgery in which a tumour had been expelled from her breast.

This development follows on the heels of the trial Magistrate court's option of N100,000 fine for the offence, a judgement which had been overturned by the High Court, replacing the option of fine with a five-year jail term.

Obviously dissatisfied by the ruling, Ibinabo had filed an appeal through her lawyer, Mr Nnaemeka Amaechina, urging the court to reconsider her sentence.

The appellate court, however, had dismissed Fiberisima's appeal, reaffirming the decision of the Lagos High Court.
