Injustice: Outrage as man escapes prison for beating up paralysed girlfriend

Michelle Smith, who is paralysed from the chest down, has spoken out against her boyfriend's sentence at Ayr Sheriff’s Court after he was only given a community order.

The paralysed woman has spoken out after her fiance, Iain Paton, was let off the hook after beating her up. Mr. Paton brutalised his girlfriend, Michelle Smith, tying her to her wheelchair, repeatedly punching her in the face, and dragging her around by her hair.

Despite the assault on the disabled woman, though, he escaped jail time. He was instead given 105 hours of community service and ordered to pay £300 in compensation. Paton pleaded guilty to assault to injury in March.

Sheriff Mhairi McTaggart told Mr. Paton in court: "By a small margin I am not sending you to prison."

The girlfriend has now taken offense to the court's decision. Michelle, who was left with a broken nose and severely traumatised following the attack in December said, "Why on earth should any woman put their trust in the legal system when this is the result? There really is no justice.

"it's like the court is telling him it was alright to do that to me. It’s sickening."

Speaking on the night of the attack, Michelle said: "I don’t have a clue what made him crack, I can only think it’s because he’d been drinking. It seemed like the attack went on forever.

"I kept begging him to stop because he was doing me in but he just said no."

He had pushed her into the middle of the road and left her to go back to the pub.

Michelle, confused, queried the system: "How can there be any 'small margin' about it? A man beats up a woman in a wheelchair and doesn’t go the jail? Where’s the ‘margin’ in that?"
